What Smart Agreements is

An upgrade to your MyHR subscription. It adds Smart Agreements to your plan, so you can generate employment agreements yourself within the Platform, with MyHR's smarts built in.

How you get it Two ways: you upgrade in the Platform, or, if you are in an eligible group, we activate it for you and tell you first, so you can opt out before it starts.
What it costs Smart Agreements moves you to an upgraded per-person or tier rate. The upgraded price is shown to you before you upgrade or in the notice we send if we are activating it for you. It is part of your subscription, not a separate bill or a per-document charge.
Your term does not change Upgrading does not change the length of your subscription or your renewal date. Only your per-person rate changes.

When the new price applies

The feature is available as soon as the upgrade is made. Your new per-person or tier rate is reflected from your next invoice.

Choosing not to

If we are activating it for you, you can opt out before the activation date using the link in our notice. If you opt out, you stay on your current package, unchanged.

Smart Agreements is here to stay

Once you upgrade, Smart Agreements becomes a permanent part of your subscription and your everyday workflow.

What happens to Fast Track

Smart Agreements is the new way to generate agreements. Once you upgrade, you no longer need Fast Track, and it is retired from your account.

Which terms apply

Your MyHR Terms and Conditions apply and remain unchanged. This page explains how the upgrade works within them.

 1. About these upgrade terms

1.1 These terms explain how the Smart Agreements upgrade is added to your MyHR subscription. They form part of your agreement with MyHR and should be read with your MyHR Terms and Conditions.

1.2 Your MyHR Terms and Conditions continue to govern your subscription. This page does not replace them. It explains how the upgrade works within them. Words defined in the Terms and Conditions have the same meaning here, including Order Form, Fees, Initial Term, Subscription Term, Services, and Authorised User.

1.3 The MyHR Terms and Conditions that apply to you are those in force for your subscription at the time. If you are still on a previous version of the Terms and Conditions, the upgrade is still added to your subscription on the terms set out on this page, and MyHR's current Terms and Conditions apply to your subscription from the date they take effect for you.

1.4 By upgrading to Smart Agreements, or by not opting out where we activate it for you, you agree that Smart Agreements is added to your subscription on these terms and that your per-person rate changes as set out below.

2. What Smart Agreements is

2.1 Smart Agreements is a Platform feature that lets you generate employment agreements automatically, with MyHR's business logic and document rules built in. Once added to your subscription, it forms part of the Services.

2.2 Smart Agreements is the new way to generate employment agreements in MyHR, and it replaces the previous Fast Track service. Once you upgrade, you generate standard agreements yourself within the Platform, and Fast Track is retired from your account. If you do not upgrade, you stay on your current package and Fast Track remains available to you for now.

2.3 Smart Agreements generates documents based on the information you provide and the rules configured in the Platform. As with all MyHR Documentation and Advisory Services, you remain responsible for reviewing each agreement and for your employment decisions, in accordance with the Terms and Conditions. Smart Agreements does not change that responsibility.

3. Your subscription and price

3.1 Adding Smart Agreements moves your subscription to the Smart Agreements per-person or tier rate. This rate is shown to you before you upgrade, or set out in the notice we send if we are activating it for you.

3.2 Upgrading does not change the length of your subscription, your Initial Term, or your renewal date. It changes the per-person or tier rate at which your subscription is billed. It is not a separate billing item and not a one-off or per-document charge.

3.3 The feature is available as soon as the upgrade is made. Your new per-person or tier rate is reflected from your next invoice, and will apply to each invoice after that.

3.4 Same as now, your subscription is billed on your person count at the time of each invoice, at your per-person or tier rate. Any total shown to you at upgrade is an estimate based on your current employee count, and your actual invoice may differ if your person count changes or your subscription includes other items.

3.5 All Fees are exclusive of applicable taxes, which are added where applicable, as set out in your Jurisdiction Schedule.

4. How you upgrade

There are two ways Smart Agreements is added to your subscription.

4.1 You upgrade in the Platform

(a) You can add Smart Agreements to your subscription at any time through the Platform.

(b) Before you confirm, the Platform shows you your new per-person or tier rate and an estimate of your new monthly total.

(c) By confirming the upgrade, you agree to add Smart Agreements to your subscription on these terms and to your new per-person or tier rate. A request made through your account by an Authorised User is treated as authorised by your organisation.

(d) The feature is available once you confirm, your new per-person or tier rate is reflected from your next invoice, and Fast Track is retired from your account.

4.2 We activate it for you, with the choice to opt out

(a) If your organisation is in a group we have identified as suited to Smart Agreements, we may activate it for you on a set date. We will tell you before we do.

(b) Our notice will set out the activation date, your new per-person or tier rate, and how to opt out.

(c) You can opt out at any time before the activation date, using the method in our notice. If you opt out, you stay on your current package, unchanged, and Smart Agreements is not added.

(d) If you do not opt out before the activation date, Smart Agreements is added to your subscription on that date, your new per-person rate is reflected from your next invoice, and Fast Track is retired from your account.

5. How the upgrade fits your term

5.1 If you are in an Initial Term or renewal term, Smart Agreements is added to your current subscription for the rest of that term. Your term length and renewal date do not change. You continue to be billed monthly on your person count, at your new per-person rate, and your subscription renews in the normal way under the Terms and Conditions.

5.2 If you are on a month-to-month (rolling) subscription, Smart Agreements is added to your subscription and continues each month while your subscription continues, at your new per-person or tier rate.

6. Once you have upgraded

6.1 Once Smart Agreements is active, it becomes a permanent part of your subscription and your Services for the remainder of your Subscription Term.

6.2 Because Smart Agreements replaces Fast Track and becomes part of your everyday workflow, it stays on your subscription once added.

7. Everything else

7.1 In all other respects, your MyHR Terms and Conditions, Jurisdiction Schedule, and Privacy Policy continue to apply to your subscription and your use of Smart Agreements.

7.2 If there is any inconsistency between this page and your Terms and Conditions, the Terms and Conditions prevail. This page explains how the upgrade works; it does not vary the Terms and Conditions.
